1. How it works
kubidi is an app that aims to help consumers and boost local merchant's business. Kubidi is powered by Artificial Intelligence to offer consumers and merchants advanced marketing tools and helps to save time and money both in marketing and discovering best offers. By creating an account you agree to the Terms and Conditions. Kubidi has no liability on disputes between Merchants and Consumers. Kubidi will provide all the necessary data to the authorities that will execute the necessary investigations to solve the dispute. By taking advantage and benefits of the Kubidi platform, the Consumer agrees to receive messages and advertisements from Merchants. Merchants and Consumers can delete their account at any time by sending an email to support@kubidi.com. Kubidi is FREE for consumers. Merchants have 2 convenient plans with a 5% fee on sales. START is the starting plan to sell on kubidi. BUSINESS is the plan with the most advanced AI features to boost business in an omnichannel shopping experience. Using artificial intelligence with virtual assistants increases sales and improves customer service. Merchants can send advertisements via app and via email to the target market, it helps in viral marketing to communicate messages to all users of the platform and allows to easily integrate kubidi eCommerce sites. The BUSINESS plan has an additional fee of 5000 THB per month.
Consumers can use artificial intelligence to communicate with stores located nearby (within 50 km), discover market trends and get the best promotions using discount and gift cards. Consumers can request immediate delivery of their groceries or they can pay and collect later at the store. With every purchase, consumers get points that they can spend in stores. Unused points can be exchanged between users. Artificial intelligence allows users to have a more engaging shopping experience in omni-channel mode, saving time and money and always remaining updated on offers and trends.
Merchants can use AI to communicate with consumers located nearby (within 50 km), discover market demands, increase sales and customer engagement. Merchants can add products and manage inventory. They can create promotional campaigns and can train the AI to provide information and help to consumers by pushing for product sales 24/7. Merchants can create simple surveys to immediately gain insight into consumer preferences and can create posts to update their customers on new initiatives and discount cards. Finally, merchants can ask the AI for advice in particular situations when it is necessary to obtain in-depth information on important decisions.
2. Who
You may use the Services only if you agree to enter into a binding contract with kubidi and if you are not a person who is prohibited from receiving the services under the laws of the applicable jurisdiction. However. If you agree to these Terms and are using the Services on behalf of a company, organization, government, or other legal entity, you represent and warrant that you are authorized to do so and that such person does not implement discriminatory policies relating to the sex, religion and human rights of registered users.
3. Privacy
Our Privacy Policy describes how we handle the information you give us when you use our Services. By using the Services, you consent to the collection and use (as set out in the Privacy Policy) of such information. kubidi does not provide sensitive and non-sensitive user data to third parties. All information and texts posted by the user remain and will remain protected forever. Some information can be provided to a judicial authority only in case of fraudulent or offensive use according to the terms of use and only to natural or legal persons who protect human rights.
4. Contents
You are responsible for your use of the Services and the Content you provide, including compliance with applicable laws, rules and regulations. You must only provide Content that you believe you can share with others and that does not harm the dignity of others. Any use of or reliance on Content or documents posted through the Services or obtained through the Services is at your own risk. We do not endorse, represent, or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications posted through the Services or the opinions expressed through the Services. You understand that by using the Services you may be exposed to Content that may be offensive, harmful, inaccurate or inappropriate or, in some cases, to messages that have been misinterpreted or misleading. Responsibility for the Contents lies exclusively with the person who created them. We cannot monitor or control Content posted through the Services and are not responsible for it. We reserve the right to remove Content that violates your Consent, including, but not limited to, copyright and trademark violations or other misappropriation of intellectual property, impersonation, illegal conduct or harassment. Any content that violates the terms of use can lead to the blocking of the user account and in the most serious cases to the transmission of information to the competent judicial authority as long as it is able to protect human rights.
5. Account
You need to create an account to use our Services. You are responsible for safeguarding your account, so please use a secure password and limit the use of this account. We cannot and will not be liable for any loss or damage arising from your failure to comply with the foregoing. You can control most communications from the Services. We may need to provide you with certain communications, such as service announcements and administrative messages. These communications are considered part of the Services and your account, and you may not have the ability to opt-out of receiving them. If you added your phone number to your account and later change or deactivate it, you must update your account information to prevent us from communicating with anyone who acquires your old number. We recommend that you change your password every 6 months. Some information such as email address and gender indicated during registration can only be changed by sending an email to support@kubidi.com
6. Disclaimer
YOU AGREE THAT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, kubidi SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OR FOR ANY LOSS OF PROFITS OR REVENUES, WHETHER DIRECT OR INDIRECT, OR FOR ANY LOSS OF DATA, USAGE , GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; (iii) ANY CONTENT OBTAINED FROM THE SERVICES; OR (iv) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL kubidi'S LIABILITY EXCEED THE GREATER OF A HUNDRED UNITED STATES DOLLARS ($100.00) OR THE AMOUNT, IF, IF YOU PAID kubidi, IN THE LAST SIX MONTHS FOR SERVICES WHICH GIVE RISE TO THE CLAIM. THE LIMITATIONS IN THIS SUBSECTION APPLY TO ANY BASIS OF LIABILITY, WHETHER WHETHER BASED IN WARRANTY, LIABILITY IN CONTRACT, STATUTORY, IN CONTRACT (INCLUDING IN NUMPTY), OR OTHERWISE, WHETHER kubidi HAS BEEN ADVISED OF ANY SUCH DAMAGES, AND EVEN IF A REMEDY SET FORTH IN THESE TERMS HAS FAILED OF ITS ESSENTIAL PURPOSE.
7. Shipping Policy
Kubidi delivers within 24 hours. For orders placed after 6.00 PM we will deliver the next day or the same day upon availability. Orders are also delivered on weekends or holidays. In causes of force majeure that we cannot foresee, deliveries may be delayed by a few days. If there will be a significant delay in shipment of Your Order, The merchant will contact You via app or telephone.
8. Return Policy and Procedure
The local merchant is responsible for protecting the rights of the consumer. Kubidi requires all merchants to adopt a returns policy in order to instill confidence in the purchases made by consumers. The merchant must provide for the return and exchange of goods for defective products or for products that do not satisfy customers and must be returned in their original packaging. Returns are not applicable for perishable products or for some health and personal care items. The return procedure must be agreed between the consumer and the merchant via email. Returns will not be sent in cases where the product is not defective and this is agreed directly with the merchant. Shipping costs are managed by the merchant on a case-by-case basis based on the reason for the return. If the purchased product has no guarantee certificate, the consumer has 7 days to inform the merchant of willing to return the product.
9. Refund and dispute policy
Refunds must be agreed directly with the local merchant according to the current legislation. Refunds can take 5-10 days for them to be credited back to the customer account if the payment has been executed online. In case of purchasing at the store, the refund might be immediate and it depends on the store opening day / time. We can support consumer protection by giving information about the rights and legislation in the specific country by sending an email to: support@kubidi.com
10. Delete of the Account
By following the instructions in the link located in the "Profile" section, your account will be deactivated. Once deactivated, your kubidi account, your photos will no longer be visible on kubidi.com. Up to a maximum of 30 days after deactivation, however, it is possible to restore your kubidi account if it was deactivated accidentally or by mistake. All information, messages sent to other users and photos will be permanently deleted after a period of 3 months.
